Government Amends the Procedure for Retaining Critical Enterprise Status and Deferring Employees
By Resolution No. 862 of July 1, 2026, the Government amended basic resolutions No. 76 and No. 692. These innovations significantly optimize the process for companies that already hold critical enterprise status, while introducing strict deadlines for confirming this status.
Simplified Mechanism for Extending Critical Status
For enterprises whose criteria for determining critical importance remain unchanged, the requirement to undergo the full renewal procedure has been abolished. To ensure that the current decision remains valid for the entire initially planned duration (without being limited by the September 1, 2026 deadline), enterprises are required to submit the following documents by August 10, 2026:
- A certificate regarding the amount of the accrued average salary of insured individuals (employees);
- A tax return detailing the amounts of income accrued/paid to individuals, the amount of withheld tax, and the accrued Unified Social Contribution (ЕСВ) for the last calendar month.
Timely submission of these documents will confirm compliance with the salary criterion and automatically preserve the status.
Validity of Deferments and Employee Accounting Rules
- Retention of Deferments: All previously granted draft deferments remain valid for the period for which they were issued, but no longer than the duration of the decision on the enterprise’s critical status itself.
- Accounting for Part-Time Employees and Individuals with Other Grounds for Deferment: The Government has clearly regulated the method for counting such employees. From now on, they are included in the total number of conscripts at only one workplace—the basic criterion being the enterprise where the duration of employment is the longest.
