Protecting the Rights of Construction Applicants: New Electronic System Functionality for Appealing Refusals to Issue Urban Planning Conditions and Restrictions
Today, the State Inspectorate of Architecture and Urban Planning (DIAM) announced the launch of a new feature in the Unified State Electronic System in the Construction Sector (EDESSB): submitting appeals against refusals to issue Urban Planning Conditions and Restrictions (MUO).
If the application is granted, the client gains the right to proceed with further object design without obtaining the MUO!
This appeal mechanism emerged this year, and now the regulatory option is supported by technical capabilities: the application can be submitted via the EDESSB or the Unified State Web Portal of Electronic Services (Diia).
Previously, handling groundless refusals for MUO was largely unregulated, with court proceedings being the only route for protection.
How to Use This Protection Mechanism
– Locate the Service: Find “Appeal against a decision to refuse MUO issuance” in your EDESSB personal account.
– Fill in the Details: Specify the name of the construction object, the electronic system registration number of the MUO application, and the registration number of the contested refusal decision.
– Attach Documentation: Include an explanation detailing why the refusal is unjustified and, if available, an extract from the urban planning documentation.
-DIAM reviews the application within 20 working days. If necessary, the Inspectorate may request required documents and materials directly from the authorized urban planning and architecture authority.
Results and Benefits
You will receive a notification in your personal account with the outcome: either the refusal decision remains unchanged (if no violations are found) or the application is granted (if the refusal was unjustified).
