Appealing Refusals of Urban Planning Conditions and Restrictions: A New Pre-Trial Mechanism
On 24 April 2026, the Cabinet of Ministers of Ukraine adopted a significant package of decisions aimed at streamlining construction regulations and accelerating reconstruction efforts. One of the key innovations is a new pre-trial mechanism for appealing refusals to grant Urban Planning Conditions and Restrictions.
A new analytical article by Ivan Fedorin, Counsel for Construction at Altelaw & Sempra, titled “Appealing Refusals of Urban Planning Conditions and Restrictions: A New Pre-Trial Mechanism,” has been published in Legal Newspapper.
The article examines:
- How the mechanism for appealing refusals to grant urban planning conditions and restrictions via DIAM (State Inspection of Architecture and Urban Planning) currently operates;
- The specific documents and particulars that must be included in the statement of appeal;
- The timeframes for reviewing the application and the legal consequences of its approval;
- The regulatory risks that must be assessed proactively when employing this new instrument.
This publication will be of significant value to project owners, property developers, real estate investors, and legal practitioners managing construction projects or confronting refusals from urban planning and architecture authorities.
