On April 24, 2026, the Cabinet of Ministers of Ukraine adopted a resolution introducing a pilot project specifying the delivery of permitting and registration services in the construction sector.
From now on, project developers can independently choose which authority to apply to for documents granting the right to perform preparatory or construction works, as well as for commissioning completed facilities: either the local State Architectural and Building Control (GABC) body or the State Inspectorate of Architecture and Urban Planning of Ukraine (DIAM).
This applies to objects built under a construction passport, class CC1 consequence objects, and class CC2 objects—within the scope of powers delegated to the respective local authority.
If a developer chooses DIAM, this authority will handle the issuance (registration), return (refusal of issuance), modification, and termination (cancellation) of documents granting the right to perform preparatory and construction works, as well as the commissioning of completed construction projects.
When DIAM is chosen to provide administrative services, it will also exercise state architectural and building control over the relevant project until it is officially commissioned.
Impact: This introduces an alternative administrative service mechanism and creates a competitive environment among construction regulatory bodies. If a local GABC operates inefficiently, developers are no longer tied to it and can turn to DIAM instead.
This approach serves as more than just a procedural change; it acts as a tool to reduce administrative pressure, improve service quality, and establish more predictable conditions for the construction business.
Altelaw&Sempra, with support from industry associations, has repeatedly drawn the Government’s attention to the need to allow developers a choice between local GABC bodies and DIAM. The previous lack of alternatives fostered corruption risks at the local level and led to unjustified refusals in issuing permitting documentation.
The implementation of this pilot project aims to ensure that developers receive high-quality administrative services at no additional cost. We look forward to seeing this mechanism put into practice.
