Ihor Retivov, Partner at Altelaw&Sempra and Chairman of the Ukrainian Wind Energy Association (UWEA) Committee on the Development and Implementation of Energy Storage Systems (ESS), participated in a joint meeting hosted by the European Business Association (EBA), SUNSAY NRG, Photomate Ukraine, and Huawei Ukraine.

The event focused on practical approaches to ensuring business energy resilience amid systemic damage to energy infrastructure. The discussion centered on solutions currently being deployed by Ukrainian companies: solar power plants, energy storage systems (ESS), autonomous operation scenarios, economic optimization, and the legal and commercial models for their implementation.

In his presentation, Ihor Retivov focused on the legal frameworks that allow businesses to increase energy independence while remaining compliant with regulatory requirements. Specifically, he explained the mechanism for obtaining Active Consumer status, which enables companies to legally sell surplus electricity without a generation license, provided they adhere to established capacity limits.

“Today, business energy independence is not just a matter of hardware, but of the correct legal model. The status of an Active Consumer allows companies to integrate their own generation and ESS into the market, reducing costs while legally monetizing surplus electricity without additional regulatory barriers,” noted the Altelaw & Sempra partner.
