ALTELAW team has successfully defended the client’s rights in a dispute with the National Energy and Utilities Regulatory Commission

ALTELAW Law Firm has successfully defended the interests of its client, an electricity trader, ECOTECH ENERGY LLC, in a dispute with the National Energy and Utilities Regulatory Commission (NEURC) on the invalidation and cancellation of a resolution imposing a fine of UAH 1.7 million. 

The Dnipropetrovs’k District Administrative Court, in case No. 640/37669/21, confirmed that the Regulator’s decision to fine ECOTECH ENERGY LLC was unlawful and should be canceled.

In the court proceedings, ALTELAW team proved that the NEURC violated the basic principles of proportionality and proper justification of sanctions, failing to properly consider the explanations and evidence of the absence of intentional actions of the trader and real damage to the electricity market.
