Construction Project Owners Will Be Able to Independently Choose Where to Apply for Permit Documentation: To DIAM or the Local DABC Authority
On 24 April 2026, the Cabinet of Ministers of Ukraine adopted a resolution introducing an experimental project concerning the specifics of providing permitting and registration services in the construction sector.
Henceforth, the construction project owner will be empowered to independently choose which authority to apply to for documents granting the right to execute preparatory or construction works, as well as for the commissioning of completed construction facilities: either the local state architectural and construction control authority (DABC) or DIAM (State Inspection of Architecture and Urban Planning).
This applies to facilities constructed on the basis of a construction passport, facilities with consequence class CC1, and CC2 facilities—within the scope of powers delegated to the respective local authority.
In the event the project owner selects DIAM, this specific authority shall execute:
- the issuance (registration), return (refusal to issue), amendment, and termination (cancellation) of documents granting the right to execute preparatory and construction works, as well as the commissioning of completed construction facilities.
That is, if DIAM is selected as the authority providing administrative services, DIAM shall also exercise state architectural and construction control over the respective construction facility up until the moment of its commissioning.
Effectively, this entails the introduction of an alternative mechanism for obtaining administrative services and the fostering of a competitive environment amongst authorities within the construction sector. Should a local DABC authority operate inefficiently, the project owner is no longer reliant upon it and may directly apply to DIAM.
Such an approach is significant not merely as a procedural amendment, but as an instrument for alleviating administrative pressure, elevating service quality, and cultivating more predictable conditions for the construction business.
We have repeatedly, with the backing of industry associations, drawn the Government’s attention to the necessity of introducing a choice between local DABC authorities and DIAM, as the absence of such an alternative generated corruption risks at the local level and resulted in unjustified refusals to issue permitting documentation.
It is anticipated that the implementation of this experimental project will enable project owners to receive high-quality administrative services without incurring supplementary costs.
