Participated in the XIII Business & Legal Tax Forum
This week, Altelaw&Sempra Senior Partner Olga Savchenko participated in the XIII Business & Legal Tax Forum, organised by PRAVO.UA. She took part in a session dedicated to strategic issues within the tax sphere: current legislative amendments and the harmonisation of Ukrainian tax legislation with EU law, the impact of judicial practice on law enforcement, and the interaction between businesses and tax authorities.
In her presentation, Olga Savchenko focused on the expectations and reality of sectoral tax incentives in Ukraine—with a specific emphasis on the energy sector.
“Energy legislation is evolving exceptionally rapidly, whereas the corresponding changes in taxation are adopted at a significantly slower pace. This creates additional regulatory risks for market participants and complicates the planning of investments and financial models,” emphasised the Altelaw&Sempra Senior Partner.
Separately, Olga commented on the practical tax issues that are currently impacting projects and the operational activities of energy companies: the accounting and depreciation of Energy Storage Systems (ESS), the regulation of the value of Guarantees of Origin, the status and taxation nuances of active consumers, excise issues for specific categories of producers, as well as the depreciation of SPPs.
Working with energy projects is not limited to sectoral regulation: tax decisions directly dictate payback periods, financial models, and overall business resilience. The Altelaw&Sempra team possesses practical expertise in the tax aspects of the energy sector—from project structuring and accounting approaches to risk assessment and dispute resolution. This is precisely why we approach such assignments comprehensively, taking into account both the energy and tax dimensions.
