Amendments to the Procedures for Commissioning Completed Construction Projects and the Operation of the Unified State Electronic System in the Construction Sector (USESCS)

On January 21, 2026, the Cabinet of Ministers of Ukraine adopted Resolution No. 50, introducing amendments to the procedures for commissioning completed construction projects and the functional regulations of the Unified State Electronic System in the Construction Sector (USESCS). The primary innovation is the implementation of the “Transparent Construction” (Prozore Budivnytstvo) mobile application as a mandatory tool for conducting on-site inspections of projects categorized with CC2 and CC3 consequence classes.

Previously, regulations required the creation of a checklist and photographic documentation of inspection results, but the method of execution was largely left to the inspector’s discretion. Resolution No. 50 fundamentally alters this mechanism: the generation of checklists, as well as photo and video documentation, must now be performed by officials of the State Architectural and Building Control authority exclusively through the electronic system, specifically via the mobile app. Upon completion of the inspection, the inspector applies a Qualified Electronic Signature (QES). The generated checklist, along with all photo and video materials, is automatically transmitted to the Construction Activity Registry within the USESCS. Once submitted, these data points cannot be modified or supplemented outside the system.

In parallel, the resolution approved a new edition of the on-site inspection checklist. It features a rigorous structure and a detailed list of mandatory verification elements: ranging from the availability of project documentation and work logs to accessibility for persons with disabilities, fire safety, engineering networks (gas, electricity, water, sewage, heating, ventilation), elevators, landscaping, and the presence of civil defense structures. Each item in the checklist requires a “Completed / Not Completed” status and mandatory photographic evidence of the corresponding element.

Furthermore, the “Transparent Construction” mobile app has been officially integrated into the USESCS framework. It serves as the primary conduit for generating and transmitting electronic documents, photos, and video recordings to the official responsible for the final decision on commissioning the facility.

In practical terms, this shifts the commissioning procedure from a model reliant on individual inspector discretion to a standardized digital procedure. Inspectors can no longer alter the inspection sequence, bypass specific elements, or finalize the review without fully completing the checklist. Photographic documentation is now a mandatory component of every verification point, with materials feeding directly into the USESCS.

While Resolution No. 50 does not alter the fundamental architecture of the permitting system, it significantly transforms the mechanics of its implementation during the commissioning stage. The primary outcome of this reform is a transparent and audited digital process, drastically narrowing the window for informal agreements and “flexible interpretations.”
