CMU Abolishes Restrictions on Changing the Functional Purpose (Zoning) of Territories
On December 3, 2025, the Cabinet of Ministers of Ukraine (CMU) adopted Resolution No. 1574, amending the Procedure for the Development and Approval of Urban Planning Documentation. One of the key provisions was the removal of the norm that restricted the possibility of changing the functional purpose of territories within a Detailed Territory Plan (DTP).
The previous version of the Procedure stipulated that during the development or adjustment of a DPT, changing the functional purpose was only permissible within the same subgroup. This meant changes were restricted to the established group of functional zones.
For example: If a plot was designated as “Residential Development,” the DPT could change its function from “manor-house development” to “multi-apartment development.” However, converting the plot to “Public Development”or “Industrial Territories” was impossible, as it fell outside the defined subgroup. Similarly, the functional purpose within the “Industrial Territories” group could only be altered within that group (e.g., to “innovative complex territories”) but could not be rezoned for residential or public development.
The new version of Resolution No. 1574 removes this restriction. Henceforth, the DPT may stipulate a change in the functional purpose of the territory, irrespective of the previous group or subgroup, provided it complies with higher-level urban planning documentation.
This expands the possibilities for territorial planning and development. The Resolution also defines the procedure for handling urban planning documentation that contains restricted access information. Such materials must be created as separate electronic documents and are not uploaded to the Register of Urban Planning Documentation.
