Olga Sydorchuk participated in the “Territorial Planning and Development” webinar

At the very end of the year, Olga Sydorchuk, Partner at Altelaw&Sempra and Chair of the Committee on Legislative and Regulatory Affairs of the Confederation of Builders of Ukraine (CBU), participated in a practical CBU webinar regarding Amendment No. 1 to DBN B.2.2-12:2019 “Planning and Development of Territories,” which entered into force on January 1, 2026.

The focus of Olga Sydorchuk’s presentation was on changes that will directly impact development and infrastructure projects starting in early 2026. A key highlight is the consolidation of the “one land plot – one functional zone”approach. The boundaries of functional zones may no longer pass through a single land plot, necessitating a revision of planning approaches within the framework of Detailed Plans of Territories (DPT) and General Plans.

Discussions also covered updates regarding landscape and recreational areas, where a clear distinction is now made between public use, restricted use, and special-purpose territories. Furthermore, the issue of “blue lines” was addressed, noting the current lack of comprehensive procedural regulation for such zones.

Of significant practical importance is the revised approach to sanitary protection zones. The DBN has eliminated the possibility of reducing them to 30 meters; instead, the width of such zones must now be determined in accordance with DSP-173-96. This directly affects the siting of facilities in proximity to water intake structures.

In conclusion, Olha drew attention to the updated Annexes to the DBN, specifically regarding educational and healthcare facilities, the classification of streets and roads, service radii, and mandatory setbacks from gas stations to buildings and utility networks. These provisions require separate analysis during the design phase.
